Liability

You have sole responsibility for any data stored on your device and we accept no liability for loss or corruption of such data howsoever caused. It is your responsibility to keep a record of any such data. If you return an item to us for whatever reason, we do not take any liability for any data on the device or for the loss and corruption of any data. 

By sending your device to Grade Mobile, you agree to release us from all claims, damages or losses with respect to the device and any other item sent to us with the device, any data stored therein or on any media used in conjunction with the device and/or any accessories, (This could be in the form of personal details, SMS, photos, games, songs or other data). We accept no responsibility in relation to the security, protection, confidentiality or use of such data and it is the responsibility of the customer to ensure that such data is removed from the device and/or any accessories before sending the device to GradeMobile.

Please ensure your data is wiped or backed up before sending your device to us. We do not offer a data recovery service. Pin Locks and passwords must be removed before you send your device to us. If we receive a returned device with a Pin Lock and/or iCloud on the device, we may reject your return. We advise that all sim cards, memory cards, and accessories are taken off the device before returning a device for a refund, repair or replacement. We will not be liable for the loss of any accessories, sim card, memory or any item sent back to us. 

Grade Mobile respects your privacy and is committed to protecting your personal data. This privacy notice will inform you as to how we look after your personal data and tell you about your privacy rights and how the law protects you. It applies to information we collect in relation to:

  • Users of our website;
  • People who use our services;
  • ˙supply us with goods or services;
  • People who contact us via any medium (e.g through our website, by post, email, telephone or social media).

Controller and contact information

Grade Mobile (Part of O G Exclusives London Ltd)  is the controller and responsible for your personal data (collectively referred to as “Grade Mobile”, “we”, “us” or “our” in this privacy notice).

Third-party links

Our website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy notice of every website you visit.

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together follows:

  • Unknown Data includes data on devices received for erasure and destruction services, where we do not access or record the data and simply erasure/destroy.
  • We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

      You will receive marketing communications from us if you have requested information from us or purchased services from us and, in each case, you have not opted out of receiving that marketing.

      We will get your express opt-in consent before we share your personal data with any company outside the OG EXCLUSIVES LONDON group for marketing purposes.

      We may contact you to leave a review of our products or services on one of our own sites or a third party review aggregate such as Trustpilot. 

    • Opting out

      You can ask us or third parties to stop sending you marketing messages at any time by opt-out links on any marketing message or emails sent to you at any time.

      Where you opt out of receiving these marketing messages, this will not apply to personal data provided to us as a result of a service purchase, product/service experience or other transactions.

  • HM Revenue & Customs, regulators and other authorities acting as processors or joint controllers based in the United Kingdom who require reporting of processing activities in certain circumstances.

If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.

    We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

    DATA RETENTION

    How long will you use my personal data for?

    We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

    To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

    By law we have to keep basic information about our customers (including Contact, Identity, Financial and Transaction Data) for six years after they cease being customers for tax purposes.

    In some circumstances you can ask us to delete your data we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

    Time limit to respond

    We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

     

    Amendment  

    Changes to the Terms. Grade Mobile reserves the right to make amendments to these Terms and our sites and prices from time to time, without prior notice. Any updated terms will be posted onto the site following such amendments.

    Force Majeure

    Under no circumstances shall Grade Mobile, or its employees, be considered in breach of these Terms or be held liable to the extent that performance of their respective obligations (excluding payment obligations) is prevented by any delay, failure or disruption of the content or services delivered resulting directly or indirectly from acts of nature, forces or causes beyond our reasonable control, including without limitation, Internet failures, computer, telecommunications or any other equipment failures, electrical power failures, strikes, labour disputes, riots, insurrections, civil disturbances, shortages of labour or materials, fires, flood, storms, explosions, acts of God, war, governmental actions or restrictions, orders of domestic or foreign courts or tribunals or non- performance of third parties which hinders Grade Mobile or our employees from performing our obligations under these terms. 

    Returns

    To schedule a return please contact our support team via sales@grademobile.co.uk. If you are eligible for a return our team will provide you with a prepaid return label. If you choose to return your item using your own courier, we won’t be able to cover your return expenses. 

    To complete your return, we require a receipt or proof of purchase. You must notify us within 30 days of receiving your item to be able to cancel your purchase. Please ensure your data is wiped or backed up before sending your device to us. We do not offer a data recovery service. Pin Locks and passwords must be removed before you send your device to us. If we receive a returned device with a Pin Lock and/or iCloud on the device, we may reject your return. We advise that all sim cards, memory cards, and accessories are taken off the device before returning a device for a refund, repair or replacement. We will not be liable for the loss of any accessories, sim card, memory or any item sent back to us. 

    If you return a device with an active iCloud account your return will be rejected or we may claim the value of the device from you until the iCloud account is removed. We use the Mobicode and GSMA database to check the status of our devices. If you fail to remove your iCloud account from your device we will pursue the reimbursement of any funds refunded to you based on your order's value.     If you have received a damaged item from us, such as cracked, bent or overall damaged, you must contact us within 24 hours so that we can raise an investigation with the delivery courier. 

    We will then schedule a replacement to be sent and your original item to be returned. We may need you to provide a sworn statement to help us in the claim against the delivery courier. 

    If a return has been rejected by us, and a valid return tracking number has been provided, we are no longer liable for any damage or loss to the device, the device is only under our liability when in our building.


    There are certain situations where only partial refunds are granted (if applicable). 
    Any item that is:

    • Not in its original condition
    • Damaged after receipt
    • Missing parts for reasons not due to our error

    We reserve the right to fully reject a return if any of the above are deemed to be beyond repair or severe.

    We can not refund a cancellation for any item that is returned after 30-days from the delivery date.

    If you contact us after 30-days of receiving a faulty device, we will not be able to offer a refund, only a repair or a replacement.

    If you wish to cancel your order within 30-days of receiving your product, we will be able to refund your purchase, however, a restocking charge may apply. 

    Returns after 30-days

    If a fault is to occur, we can offer a repair or a replacement. We will cover the cost of the return up to a maximum of £10.00. You are responsible for any damage or loss in transit.

    Refunds (if applicable)

    Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
    If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

    If an item is returned to us in poor condition or a condition that lowers the Grade of the device, we will not be able to provide a full refund. The overall condition/damage will determine the amount refundable. 

    If you return a device for a repair or exchange within your warranty period, the repaired or replaced device does not come with a cancellation period. We do not offer a refund for any purchase after 30 days.

    Cryptocurrency 

    Any refunds due for any orders paid using any form of cryptocurrency will be refunded using GBP as the base currency for the price of the product (including VAT where applicable), converted into Bitcoin at the current rate at the time of the refund.

    We follow this process to ensure that the equivalent sterling amount you pay at time of purchase is also returned to you (in Bitcoin) in the event of a full refund or a partial refund pro rata. Due to the volatility of cryptocurrencies we do not refund at the rate in force at the time of purchase, this is to protect both you and us from any wild fluctuations in the cryptocurrency rate. This could mean you receive more or less cryptocurrency than what was paid at the time of the transaction, however the equivalent sterling value will still be the same.

    Once a refund has been submitted, please allow 1-2 business days for the refund to be processed. You will then receive an email from Coinbase with a link to follow to download your refund back into your cryptocurrency wallet.

    This can be confusing so please don’t hesitate to contact our Customer Care team who can explain the process further.

    VAT

    Please contact us if you require a VAT receipt or guidance on the VAT Scheme of a product. Some of our devices are sold on the VAT Margin Scheme section 50A of the VAT Act 1994. If you have strict requirements for a VAT qualifying product please contact us prior to placing your order to confirm.

    Klarna

    In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment options. Payment is to be made to Klarna:

    Complaints  

    We take customer satisfaction seriously at Grade Mobile. If for any reason our customer service team - sales@grademobile.co.uk cannot resolve your issue or you wish to make a formal complaint, you can email complaints@grademobile.co.uk. Please provide as much information as possible so we can provide the most accurate resolution to your case. We aim to respond to all complaints within 10 (ten) working days. 

    If you would like to write to our head office, please first file your complaint via email to our complaints handler complaints@grademobile.co.uk, so we can advise the best point of contact for your letter.

    SECTION 1 - WHAT DO WE DO WITH YOUR INFORMATION?

    When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. We may share your personal information with our suppliers, service providers and other contractors to fulfill orders you place with us and to provide the services you request.

    When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

    How do you get my consent?

    SECTION 4 - SHOPIFY

    Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.
    Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

    Payment:
    If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.
    All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover.
    PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
